Thank you for being a part of Bhartiyneer's business CRM and communications automation platform ("the Platform"), offered under the name Vortanek. Your privacy is important to us.

This Privacy Policy explains how we collect, use, and protect information in connection with the Platform.

Scope

Bhartiyneer ("the Company," "we," "our," "us") offers a business CRM and communications automation platform ("the Platform") that enables businesses ("Customers") to manage communications with their own users and customers across supported channels and integrations. The Platform currently supports WhatsApp, and may add support for additional messaging channels, social platforms, or marketing/advertising integrations over time. This Privacy Policy applies to information collected through the Platform — by Customers who use it, and by end-users who communicate with Customers through it.

By using, registering, or signing up for the Platform, you accept the terms of this Privacy Policy. If you do not accept these terms, please discontinue use of the Platform.

This Privacy Policy is published in accordance with applicable Indian law, including the Information Technology Act, 2000 and rules made thereunder, and the Digital Personal Data Protection Act, 2023 ("DPDP Act").

Changes to This Privacy Policy

We will treat your information in accordance with applicable Indian law. This Privacy Policy may be updated from time to time to reflect business, legal, or regulatory requirements — including as the Platform adds new channels or integrations. We encourage you to periodically review this page. Continued use of the Platform after any update constitutes acceptance of the revised Privacy Policy.

Personal Information We Collect

"Personal information" means information that can identify you, and may include your name, contact details (including phone number), business information, and the content of messages or interactions exchanged through the Platform.

Collection. We collect personal information you or your organization provide when signing up for or using the Platform, including account details and, where applicable, contact information of the individuals your organization communicates with through the Platform.

Usage. We use this information to: (a) provide and operate the Platform; (b) enable Customers to manage and respond to customer conversations across supported channels; (c) improve the Platform's functionality and reliability; (d) provide customer support; (e) meet legal and regulatory obligations; (f) detect and prevent fraud, abuse, or security issues; and (g) communicate with you about your account or the Platform.

Non-Personal Information

We may collect anonymized technical and usage information (such as device/browser type and general usage patterns) to help us maintain and improve the Platform. Where non-personal information is combined with personal information, we treat the combined data as personal information.

Cookies

The Platform uses essential cookies required for authentication and session management (for example, to keep you securely signed in). We do not use cookies for third-party advertising or tracking.

Messaging Channels and Third-Party Platforms

The Platform currently uses Meta's WhatsApp Business Platform (Cloud API) to send and receive WhatsApp messages on behalf of our Customers. As the Platform adds support for additional channels or business tools (for example, other messaging or social platforms, or advertising/marketing management features), this Policy will be updated to describe how those integrations process data.

For any channel or integration, content transmitted through a third-party platform is processed by that platform as part of delivering the relevant service, subject to that platform's own data policies — we do not control that platform's infrastructure or data-center locations. For WhatsApp specifically, please refer to Meta's own WhatsApp Business Platform data policy for details.

Separately, the Platform stores message history, contact information, and related data that Customers manage through the Platform in our own systems, protected using tenant-isolated access controls and encryption of sensitive credentials. We are working toward finalizing our production hosting arrangements, including data localization, in line with DPDP Act requirements.

Third-Party Services

The Platform may link to or integrate with third-party services (such as WhatsApp, other messaging or social platforms, payment processors, or other business tools a Customer connects). These third-party services are governed by their own privacy policies, which are outside our control. We are not responsible for the privacy practices of third-party services.

Access, Correction, and Deletion

You may request access to, correction of, or deletion of your personal information, subject to applicable law. We may be unable to fulfil certain requests where retention is required by law, for fraud prevention, or where technically infeasible (e.g., anonymized backups).

Processing of Information

We and any service providers we engage may process your personal information for the legitimate purposes described in this Policy, unless you opt out where applicable. Opting out of certain processing may limit your ability to use some Platform features.

Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from your access to or use of the Platform, including through third-party services integrated with it.
